Terms of Service
Effective date: August 6, 2026
Last updated: August 6, 2026
These Terms of Service (the "Terms") govern your access to and use of Waxwing: Food Log and its related websites, applications, integrations, and services (together, the "Service"). Please read them before creating an account or purchasing a subscription.
1. About these Terms
By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The checkout page and purchase confirmation form part of your contract and set out the plan-specific price, billing period, trial, and renewal date. If plan-specific information at checkout conflicts with these Terms, the checkout information controls for that purchase.
Our Privacy Policy explains how we handle personal data. It does not form part of these Terms unless applicable law provides otherwise.
2. Operator and eligibility
2.1 Service operator
The Service is operated by:
Igor Morozov PR Računarsko programiranje BeogradĐure Jakšića 1, 2nd floor
Belgrade (Stari Grad), Serbia
Registration number: 67248732
Tax identification number (PIB): 114000236
Email: [email protected]
2.2 Eligibility
You must be at least 16 years old and legally capable of entering into these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must approve your use of the Service and any purchase. The Service is intended for personal use unless we agree otherwise in writing.
3. The Service
3.1 Food diary
Waxwing: Food Log is a food diary that lets you record meals and daily context, review entries, and export or share information. Available features may depend on your device, plan, location, and the current version of the Service.
3.2 Messaging and external AI tools
Telegram is the currently supported messaging integration. References to WhatsApp, Facebook Messenger, or other planned integrations describe possible future features and are not a promise that they will be released.
The Service does not provide its own AI meal analysis. You may choose to export data or connect the Service to compatible third-party tools, including AI tools, through supported integrations such as the Model Context Protocol. Depending on the permissions you approve, an authorized tool may read, create, update, or delete your logs and related context. You can revoke its authorization, and the third party's terms and privacy practices apply.
3.3 Not a medical service
The Service is a record-keeping tool, not a medical device or healthcare service. It does not diagnose, treat, prevent, or monitor any condition and does not provide medical, dietary, or nutritional advice. Do not use it for emergencies. Consult an appropriately qualified professional when you need health or nutrition advice.
4. Accounts and security
- You must provide accurate, current account information and keep it updated.
- You are responsible for protecting your password, email account, sign-in links, security keys, recovery codes, and connected third-party accounts.
- You are responsible for activity under your account unless it results from our failure to use reasonable security measures.
- Tell us promptly at [email protected] if you suspect unauthorized access.
5. Subscriptions and payments
5.1 Plans and prices
Current plans may include monthly and annual subscriptions and one-time or fixed-term access. The exact price, currency, billing period or access term, included features, and applicable taxes are shown before you confirm the purchase and in the purchase confirmation. Payment is due in advance unless a free trial applies.
5.2 Free trial
The annual plan currently includes a 7-day free trial for eligible new customers. The first annual payment is charged when the trial ends unless you cancel before then. Trial eligibility may be limited to one trial per person, household, account, or payment method where reasonably necessary to prevent abuse.
5.3 Automatic renewal
Subscriptions renew for the same billing period at the price disclosed for the renewal unless cancelled beforehand. One-time or fixed-term purchases do not renew unless checkout expressly states otherwise. We will provide advance notice of price changes where required by law. A price change applies no earlier than the next renewal after the notice period, and you may cancel before it takes effect.
5.4 Payment providers
Payments are processed by the provider identified at checkout, which may be an app-store operator such as Apple or Google or another payment processor. The provider may collect payment details and apply additional payment terms. If payment fails or is reversed, we may retry the charge, ask you to update the payment method, or suspend paid access after reasonable notice.
6. Cancellation, refunds, and consumer rights
6.1 Cancellation
You may cancel at any time through the billing settings provided by the payment platform. Web subscriptions can be managed through the billing link in your Waxwing: Food Log settings. Subscriptions purchased through an app store must be managed through that store.
Cancellation stops the next automatic renewal. Unless applicable law or these Terms provide otherwise, you retain paid access until the end of the current billing period. One-time or fixed-term access ends automatically after the term shown at checkout. Account deletion does not necessarily cancel a subscription, so cancel through the payment platform first.
6.2 Commercial money-back guarantee
If you purchase an initial annual subscription, you may request a refund within 30 days after the first annual charge by emailing [email protected]. The guarantee is limited to one use per customer. Approved refunds are returned to the original payment method, subject to the payment provider's processing time. This commercial guarantee does not limit mandatory legal rights.
6.3 Statutory withdrawal and remedies
Consumers may have mandatory rights that cannot be excluded by these Terms. Under Serbian consumer law, a qualifying consumer generally has 14 days to withdraw from a distance service contract without giving a reason. Consumers in other countries may have equivalent or additional rights under the law that applies to them.
To exercise a withdrawal right, send an unambiguous statement to [email protected] before the applicable deadline. You may use the optional model notice at the end of these Terms. That model notice is provided for convenience and does not replace any prescribed form or information that applicable law requires us to provide separately. If you expressly requested immediate performance during the withdrawal period, you may be responsible for a proportionate amount for service already supplied where applicable law permits.
Nothing in these Terms limits mandatory remedies for a service that is not supplied, is not as described, or does not conform to applicable legal requirements.
7. Your content and data
You retain ownership of meal entries, daily context, and other content you provide. You grant us a limited, non-exclusive licence to host, copy, process, display, transmit, secure, back up, export, and share that content only as reasonably necessary to operate and support the Service, comply with your instructions, and meet legal obligations.
You may export your data using available tools. You may request account deletion by contacting support. Deletion and retention are handled as described in the Privacy Policy, including any limited backup, security, payment, dispute, or legal-retention period.
You are responsible for the content you submit and for deciding whether and with whom to share it. Review entries and exports before relying on or sharing them.
8. Third-party services
The Service may interoperate with Telegram, payment providers, app stores, identity providers, hosting providers, and user-authorized external tools. Third parties operate independently under their own terms and privacy policies. We may replace providers within the same functional category without updating these Terms when that does not materially change the Service or your rights.
We are not responsible for a third party's independent acts, outputs, content, security, policy changes, or availability. Optional integrations act at your direction and can be disconnected or revoked. We may change or discontinue an integration if the provider changes its service, if continued operation creates legal or security risk, or if maintaining it is no longer reasonably practicable.
9. Acceptable use
You must not:
- Use the Service unlawfully or infringe another person's rights.
- Access another account or restricted system without authorization.
- Upload malware or interfere with the Service's security, integrity, or availability.
- Use automated access in a way that overloads, scrapes, or disrupts the Service.
- Abuse integrations, bypass access controls, or avoid applicable usage limits.
- Resell, sublicense, or commercially exploit the Service without written permission.
- Reverse engineer the Service except to the extent that applicable law expressly permits it despite this restriction.
10. Our intellectual property
The software, interface, design, documentation, and Waxwing: Food Log branding are owned by us or our licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No ownership rights are transferred to you.
11. Availability and changes to the Service
We use reasonable care to operate the Service but do not promise uninterrupted or error-free availability. Maintenance, security incidents, third-party outages, and events outside our reasonable control may interrupt access.
We may change features for legal, security, technical, operational, or product reasons. We will give reasonable advance notice of a change that materially reduces the core functionality of a paid subscription when practicable. Where required by law, we will provide a right to cancel and an appropriate refund or other remedy.
12. Accuracy, warranties, and health disclaimer
Food entries, exports, integrations, and third-party outputs may be incomplete or inaccurate. You should check information before relying on it, making decisions, or sharing it with a doctor, dietitian, coach, or anyone else.
To the extent permitted by law, the Service is provided "as available" without additional warranties beyond those expressly stated in these Terms. This does not exclude any warranty, conformity requirement, or consumer guarantee that cannot legally be excluded.
13. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence where applicable law does not permit a limitation.
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss arising from your reliance on user-entered information or an independent third-party service.
To the extent permitted by law, our total liability arising from the Service is limited to the amount you paid us for the Service during the 12 months before the event giving rise to the claim. For consumers, this section applies only to the extent compatible with mandatory consumer law and does not limit statutory remedies.
14. Suspension and termination
You may stop using the Service at any time, cancel your subscription as described above, and request account deletion. Export any data you want to keep before deletion.
We may restrict or suspend access for non-payment, a material breach of these Terms, unlawful conduct, abuse, or a security risk. Where reasonable, we will give notice and an opportunity to remedy the issue. We may act immediately when necessary to protect users, the Service, or third parties, or to comply with law.
If we permanently discontinue a paid Service for reasons unrelated to your breach, we will provide reasonable notice where practicable and a proportionate refund for unused prepaid time where required by law. Provisions that by their nature should survive termination will remain in effect.
15. Changes to these Terms
We may update these Terms for changes to the Service, law, security requirements, payment arrangements, or our business. The effective date above identifies the current version.
We will give at least 30 days' advance notice by email or another durable medium before a material change takes effect, unless an urgent legal or security reason requires earlier action. The notice will explain the change and any right to cancel. We will ask for renewed acceptance where required by law. Earlier versions are available on request.
16. Complaints, governing law, and disputes
Please send complaints to [email protected]. Include enough information for us to understand the issue. We will acknowledge and address consumer complaints within the time required by applicable law.
If you are a consumer in Serbia and we do not resolve your complaint directly, you may submit the dispute to a registered out-of-court consumer dispute-resolution body through the official Ministry platform. We are required by Serbian law to participate in that procedure. This does not restrict your right to seek protection before a competent court.
These Terms and the contract are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules.
If you are a consumer, this choice does not deprive you of mandatory protections or court rights available under the law of your habitual residence. Disputes may be brought before courts that have jurisdiction under applicable law. Consumers may also use any applicable out-of-court consumer dispute-resolution process.
17. General provisions
- These Terms, the applicable checkout information, and any documents expressly incorporated by reference make up the agreement between you and us concerning the Service.
- If a provision is unlawful or unenforceable, it will be adjusted only as much as necessary, and the remaining provisions will continue to apply.
- A delay in enforcing a right is not a waiver of that right.
- You may not transfer the agreement without our consent. We may transfer it as part of a reorganization, financing, or sale of the Service, provided your mandatory rights are not reduced.
- Notices may be sent electronically to the email associated with your account.
